These Terms of Service govern access to and use of Fresh From Korea, freshfromkorea.com, and purchases made through the store.
Fresh From Korea is operated by GAIA, LLC.
By accessing the store, creating an account, or submitting an order, you agree to these Terms of Service and the policies incorporated into them.
ELIGIBILITY
You must be legally capable of entering into a binding agreement in your jurisdiction.
If you purchase on behalf of another individual, business, or organization, you represent that you have authority to act on that party’s behalf.
STORE INFORMATION
We make reasonable efforts to present product names, descriptions, photographs, colors, dimensions, materials, features, compatibility information, availability, and prices accurately.
Screen settings, supplier information, manufacturing updates, packaging changes, photography conditions, and normal production variations may affect a product’s appearance.
Minor variations that do not materially change the product may occur.
PRODUCTS AND AVAILABILITY
Products may be limited in quantity, supplied by third parties, or fulfilled from different locations.
We may update, discontinue, restrict, limit, or correct a product listing before an order is accepted.
Product availability is not guaranteed until fulfillment is confirmed.
PRODUCT ORIGIN AND BRAND REPRESENTATION
Fresh From Korea is a brand name that reflects a Korean-inspired approach to beauty routines and visual culture.
The Fresh From Korea name is not a representation that every product is manufactured in, sourced from, or shipped from South Korea.
Product origin may vary by product and supplier.
We will state that a product is made in Korea or has another specific country of origin only when that statement appears in the applicable product listing and is supported by information reasonably available to us.
Customers who require country-of-origin information for a particular product should contact us before ordering.
PRICES, CURRENCY, AND TAXES
Prices are displayed in U.S. dollars unless the store expressly indicates otherwise.
Prices, availability, and offers may change without notice before an order is accepted.
Applicable sales tax and other legally required charges may be calculated and added at checkout.
Standard shipping is free for eligible orders delivered within the 48 contiguous United States and Washington, DC.
We reserve the right to correct an obvious pricing, product, technical, or typographical error.
If an order is submitted using an incorrect price or materially incorrect listing, we may contact the customer, cancel the affected product, and issue an appropriate refund.
ORDERS
Submitting an order constitutes an offer to purchase.
An automated order confirmation acknowledges that the order was received but does not necessarily mean that the order has been accepted, processed, or fulfilled.
We may refuse, limit, or cancel an order when reasonably necessary, including because of:
• Unavailable inventory.
• A pricing, product, or listing error.
• Suspected fraud or payment failure.
• Shipping, legal, or regulatory restrictions.
• Inability to verify customer, payment, or delivery information.
• Suspected unauthorized resale.
• Misuse of the store or violation of these Terms.
When a paid order is canceled, an appropriate refund will be issued to the original payment method.
PAYMENT
You agree to provide current, complete, and accurate billing, payment, contact, and delivery information.
Payment processing is provided through Shopify and the payment methods displayed at checkout.
Fresh From Korea generally does not directly store complete payment-card numbers.
SHIPPING
Shipping is governed by our Shipping Policy.
Fresh From Korea currently ships only to the 48 contiguous United States and Washington, DC.
Orders to Alaska, Hawaii, Puerto Rico, other U.S. territories, APO/FPO/DPO addresses, freight-forwarding addresses, and international destinations are not currently supported.
RETURNS AND REFUNDS
Returns, refunds, damaged products, hygiene exclusions, order changes, and cancellations are governed by our Return and Refund Policy.
The ordinary return-request period is 14 days after delivery, subject to the eligibility requirements and exclusions stated in that policy.
PRODUCT USE AND SAFETY
Read and follow all product instructions, warnings, charging directions, cleaning guidance, storage directions, and suitability information before using a product.
Use each product only for its intended cosmetic, grooming, organization, or personal-care purpose.
Stop using a product if it becomes damaged, overheats, creates unexpected discomfort, or otherwise appears unsafe.
Keep electrical products and components away from water unless the product instructions expressly state that the applicable product or component is designed for that exposure.
Cosmetic tools and personal-care products are not medical devices, medical treatment, or substitutes for professional healthcare unless a product page expressly and lawfully states otherwise.
Store content does not provide medical, dermatological, diagnostic, therapeutic, or other professional healthcare advice.
Product experiences and results vary according to the individual, technique, frequency of use, product condition, and other factors.
Consult an appropriately qualified professional regarding medical conditions, allergies, sensitivities, pregnancy, implanted devices, medication interactions, or other health concerns.
CUSTOMER ACCOUNTS
You are responsible for maintaining the confidentiality of account credentials and for activity conducted through your account.
Notify us promptly if you believe that an account has been accessed or used without authorization.
REVIEWS, COMMENTS, AND SUBMITTED CONTENT
When you submit a review, photograph, comment, testimonial, or other content, you represent that:
• You have the right to submit the content.
• The content is accurate and based on a genuine experience when presented as a review.
• The content is lawful.
• The content does not infringe another person’s intellectual-property, privacy, publicity, or other rights.
You grant GAIA, LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute submitted content for store operation, marketing, and customer-service purposes, subject to applicable law and our Privacy Policy.
We may moderate or remove content that is unlawful, fraudulent, abusive, irrelevant, misleading, contains personal information, infringes rights, or violates these Terms.
We will not require a positive review as a condition of publication or suppress a genuine negative review solely because it is unfavorable.
INTELLECTUAL PROPERTY
The Fresh From Korea name, logos, branding, website content, text, product descriptions, graphics, photographs, videos, layouts, and other original materials are owned by or licensed to GAIA, LLC and are protected by applicable intellectual-property laws.
You may not reproduce, distribute, modify, scrape, sell, exploit, or create derivative works from store content without written authorization, except as permitted by law.
PROHIBITED CONDUCT
You may not use the store:
• For an unlawful or fraudulent purpose.
• To violate another person’s rights.
• To distribute malware, malicious code, or harmful technology.
• To interfere with store operation, security, or availability.
• To collect information without authorization.
• To impersonate another individual or organization.
• To submit fraudulent orders or payment information.
• To attempt unauthorized access to an account, system, or service.
• To use automated systems in a manner that damages, disrupts, or overloads the store.
• To submit false, misleading, abusive, or unlawful content.
THIRD-PARTY SERVICES AND LINKS
The store may use or link to independent third-party services, websites, applications, payment providers, fulfillment providers, or shipping carriers.
Fresh From Korea is not responsible for the content, availability, security, products, services, or practices of an independent third party.
DISCLAIMER
To the fullest extent permitted by applicable law, the store and its content are provided on an “as available” basis.
We do not guarantee uninterrupted store operation, error-free content, specific cosmetic results, or that every product will be appropriate for every person or circumstance.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, GAIA, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from access to or use of the store or products.
Where liability cannot be excluded, it will be limited to the extent permitted by applicable law.
Some jurisdictions do not permit certain exclusions or limitations, and those provisions may not apply to every customer.
INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, damages, or expenses resulting from your unlawful misuse of the store or material violation of these Terms.
GOVERNING LAW
These Terms are governed by the laws of the State of Florida and applicable United States law, without limiting any mandatory consumer protection available in the customer’s jurisdiction.
SEVERABILITY AND NO WAIVER
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Failure to enforce a provision does not waive the right to enforce it later.
CHANGES TO THESE TERMS
We may update these Terms to reflect changes in our store, services, practices, or legal obligations.
The effective date shown at the top will be updated when changes are made.
Continued use of the store after an update constitutes acceptance to the extent permitted by applicable law.
